Boarding Contract

Boarding Contract for Cats

This Contract is between Cats Inn on the Chagrin (hereinafter called the “CI”) and the pet owner/representative whose name(s) appears below (hereinafter called the “Owner”). The term “pet” refers to all pets boarding with the same ownership.

_____Owner specifically represents that he/she is the owner of the boarding pet, or has been authorized by the Owner of the pet to enter into this Contract as the Owner’s agent.

Check in/Check out and Fees

Overnight – Always Cage-free Boarding:
Price per night: $35 and includes all day daycare
Multiple cats: $10 per additional cat

_____Owner understands check in and checkout times are by appointment only. Owner understands that extra charges will be added to bill for check in or check out outside of the appointed pick-up / drop-off hours. CI must approve said action in advance and will advise Owner of the fee amount & terms at the time the request is approved.

_____Owner understands that there is a nightly boarding fee charged on day of arrival (regardless of check in time), and there is a full-day charge for the day of departure unless you pick-up before noon.

_____ Owner understands that once the pet has been dropped off, owner is committed to paying for the entire reservation, regardless if owner ends up picking pet up early. Owner also understands that reservations can be extended only in case of advanced notice, CI approval, and availability.

_____ Owner agrees to pay the boarding rate for all services upon check in. Any overages shall be paid at the time of pickup. Owner is aware that CI only accepts payment by cash or check.

_____ Owner understands and agrees that pet shall not leave CI until all charges are paid. Owner is aware that if the date and/or time of pick up is extended without prior approval of CI there will be an additional charge.

_____Owner agrees to the CI Cancellation Policy. A $50 deposit (per pet), ($100 deposit for Thanksgiving and Christmas season) is required upon booking to confirm your pet’s reservation. This deposit will be applied toward your pet’s stay. There is a one week (7 day) cancellation policy and all reservations need to be changed or cancelled in advance to have the deposit fully refunded. YOUR RESERVATION WILL NOT BE CONFIRMED UNTIL A DEPOSIT HAS BEEN MADE.

_____ Owner understands that a No Show Fee will be charged if pet is not dropped-off or picked-up at the specified time & date reflected in the reservation. If the entire reservation is a No Show, Owner will be billed 50% of their reservation.

_____ If the Owner is running late, owner is aware that the CI has a policy of waiting no more than 15 minutes for free without exceptions.

Health and Safety

_____Owner represents that pet/s have been vaccinated against feline distemper and rabies. Please furnish paperwork of proof for our files prior to boarding. (PLEASE – do NOT get your cat vaccinated 24-48 hours prior to Boarding)

_____ CI reserves the right to refuse admittance to any pet who shows signs of illness. Despite these precautions, Owner acknowledges that Owner’s pet will be in an environment with other pets during boarding, and understands that any pet may harbor and spread a communicable disease. Owner releases CI from, and waives all claims and liability against CI for, all losses, damages, costs and expenses arising out of or in connection with any communicable disease contracted by Owner’s pet during boarding.

_____Owner represent that all pet/s are free from fleas, ear mites, ringworm, any other parasites or contagious conditions. Cats found with such conditions will not be accepted.

_____Owner represents that pet/s does not have or has not recently had an Upper Respiratory Infection – If pet is discovered with F.U.R.I., they will be removed from the facility immediately and taken to owner’s veterinarian or emergency clinic. All vet and delivery charges will apply to Owner.

_____Owner represents that all pets aged eight months or older have been spayed or neutered.

_____ Owner understands that CI staff are not veterinarians or registered veterinary technicians. CI does not board any pets with medical conditions other than those stable with oral medication.

_____ CI shall exercise due and reasonable care for each pet while boarding. Under this reasonable care, Owner releases CI from, and waives all claims and liability against CI for or attributable to, injury or illness of pet.

_____ Owner represents that pet is healthy and has not been exposed to any known communicable disease within the thirty-day period immediately prior to boarding. Owner agrees to disclose to CI all known medical conditions and/or behavior problems, which may affect pet’s care prior to check in.

_____Owner represents that pet/s have not harmed or shown aggressive or threatening behavior toward any person.

_____Owner authorizes CI and its agents and/or representatives to seek immediate Veterinary care for pet(s) in the event of any illness or injury they determine requires Veterinary care. CI will make every attempt possible to contact Owners veterinarian on file. If this fails, CI will transport pet/s to the nearest veterinarian who can accommodate the pet on a timely basis. Owner further understands and agrees that Owner is solely responsible for any and all cost including but not limited to Veterinarian services, treatment, surgery, medicine and transportation.

_____ Owner understands that if pet is not picked up within 14 calendar days after the day pet is scheduled for pick up, pet shall be deemed abandoned and then has the right to place pet with a new owner. Owner shall remain liable for all boarding fees.

RELEASE OF LIABILITY

_____ Owner releases CI from, and waives all claims and liability against CI for, damage to, or loss of, personal equipment or belongings provided by Owner for pet while the pet is boarded. Items not taken home at checkout will be donated if not picked up within 60 days of check out date.

_____ Owner understands that CI will do all it can to ensure that Owner’s pet will have a safe and enjoyable boarding experience. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OWNER (A) HEREBY RELEASES AND AGREES TO HOLD HARMLESS CATS INN ON THE CHAGRIN AND ITS OFFICERS, OWNERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY FOR ANY INJURY OR ILLNESS SUFFERED BY HIS OR HER CAT WHILE IN CATS INN ON THE CHAGRIN’S CARE; AND (B) AGREES NOT TO INITIATE ANY LEGAL PROCEEDINGS AGAINST CATS INN ON THE CHAGRIN WITH RESPECT TO SUCH RELEASED CLAIMS. WITHOUT LIMITING THE PROVISIONS ABOVE, CATS INN ON THE CHAGRIN’S AGGREGATE LIABILITY FOR FAILURE TO PERFORM UNDER THIS AGREEMENT OR ANY INJURY OR ILLNESS TO A CAT WILL BE LIMITED TO THE COST OF THE STAY DURING WHICH THE FAILURE, INJURY OR ILLNESS OCCURRED. IN NO EVENT WILL CATS INN ON THE CHAGRIN BE LIABLE FOR SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THEIR POSSIBLE EXISTENCE. OWNER SHALL INDEMNIFY, DEFEND AND HOLD CATS INN ON THE CHAGRIN HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, LIABILITIES, DAMAGES, CLAIMS, DAMAGES, FINES, COSTS, PENALTIES AND EXPENSES (INCLUDING ATTORNEYS’ FEES) ARISING FROM OR RESULTING FROM (A) ANY BREACH OF THE REPRESENTATIONS, WARRANTIES OR COVENANTS CONTAINED IN THIS AGREEMENT, OR (B) ANY ACTS OR BEHAVIOR OF THE CAT WHILE IN THE CARE OF CATS INN ON THE CHAGRIN, INCLUDING INJURY TO STAFF OR OTHER ANIMALS OR DAMAGE TO FACILITIES.
